A woman whose divorce settlement was cut when it was disclosed that she enjoyed a life of luxury with her wealthy boyfriend took her battle for a greater share of her former husband's fortune to the Court of Appeal yesterday. Jayne Shaw, 45, split from Philip Shaw, a farmer, in 1995 after 10 years of marriage. She claimed his assets, including farms covering nearly 1,500 acres in Lincolnshire, were worth million and was originally awarded to cover the cost of a home, a car and a clean break lump sum. But before the divorce was finalised in 1997 Mrs Shaw had begun a relationship with John MartinHoyes, a Lincolnshire plant hire chief, and a year later moved into his Georgian home. She claimed at district court hearings, however, that she had no plans to remarry, was struggling to survive and needed a home of her own. After learning of the relationship, Mr Shaw, 47, appealed and in September 2001 the award was cut to by Judge Victor Hall at Leicester county court. The judge heard that Mrs Shaw shared her lover's "gracious Georgian property" called Milton Farm in Harmston, Lincs, and had the use of four vehicles, including an Mercedes sports car. She also shopped frequently at Harrods and Harvey Nichols, enjoyed 15 foreign holidays, including trips to Mauritius and the Seychelles, and received gifts including Cartier earrings and two Louis Vuitton handbags, the court heard. Judge Hall set aside the original settlement because Mrs Shaw had not disclosed her true financial position. Mrs Shaw is claiming at the Appeal Court that she did disclose fully her assets and Judge Hall's settlement figure was "neither fair nor just". She wants the court to reinstate the original deal and order the sale of her former marital home, Scandova, at Covenham St Mary, Lincs, to provide her with more money. Mr Shaw lives with and cares for the couple's three daughters, Jackie, 16, Penny, 14, and Harriet, 12, at Grange Farm, Covenham, after winning a residence order in 1996. A judge hearing the case in 1998 found that Mrs Shaw was living fulltime with Mr MartinHoyes, but she claimed there were problems between them and she wanted to move back to Covenham, live on her own and be financially independent. Her lawyers claimed that Mr Shaw would be able to sell enough land to raise the money for this without jeopardising his business. Mr Shaw did raise a loan to pay his former wife which she used to buy a home in Waltham, Lincs,[url=http://www.sport.fr/smartphones/moncler.asp]moncler pas cher[/url], but he also launched an appeal, claiming that the award was too high. His wife offered to settle for and her costs if her husband paid up in full by August 1998, and Mr Shaw agreed to this. If Mr Shaw had known this, he would never have agreed to the settlement. Papers before the court showed that Mrs Shaw took out enforcement proceedings for the second instalment of her settlement in 1999, which eventually resulted in Mr Shaw's bank issuing a formal demand for to repay loans. Mr Shaw had to sell land to pay the bank, reducing his capital worth to million. His lawyers claim that Mrs Shaw was responsible for this and she must "face the consequences" of her actions. While this was happening, Mr Shaw had no direct evidence that his wife was cohabiting with Mr MartinHoyes, his lawyers are claiming. |
